Terms of Service

These Terms of Service ("Terms") govern access to and use of SinQS ("Service") operated by SinQS (Schelmseweg 5, 6816 PA Arnhem, Netherlands; contact: Herre de Jong (owner); email info@sinqsaudit.com) ("we", "us"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. The Service

SinQS provides tools to create, manage, and report audits and related documentation. Features, limits, and availability may change with reasonable notice where appropriate.

2. Accounts & security

You are responsible for safeguarding credentials and for activity under your account. Where multi-factor authentication is enabled or required, you must complete enrollment to access protected features. Notify us promptly at your support channel if you suspect unauthorised access.

3. Acceptable use

You will not misuse the Service, including by attempting to break security, overload systems, scrape in breach of technical limits, or use the Service for unlawful purposes. We may suspend access for serious or repeated violations.

4. Customer data

You retain rights to the business data you submit. You grant us permission to host, process, and display that data solely to provide and improve the Service, as described in the Privacy Policy. Where your organisation engages us as a processor, your instructions and agreement govern to the extent applicable law requires.

5. Generated reports & retention

Generated audit report files (PDFs) stored within the Service are automatically deleted after 6 months from the timestamp used by our retention purge (aligning with in-product messaging). You should download or archive reports you need to keep longer. Other data retention is described in the Privacy Policy.

6. Fees & taxes

Purchases (including credit top-ups) are processed via our payment provider. Prices may be shown excluding or including tax depending on configuration; applicable taxes are calculated at checkout where supported.

7. Intellectual property

The Service, software, branding, and documentation are owned by us or our licensors. Except for the rights expressly granted here, no rights are transferred to you.

8. Disclaimer & liability

The Service is provided "as is" to the extent permitted by law. We do not warrant uninterrupted or error-free operation. Our aggregate liability for each claim will be limited to amounts you paid to us for the Service in the twelve (12) months before the event giving rise to liability (unless mandatory law says otherwise). Nothing excludes liability that cannot be excluded by law.

9. Term & termination

You may stop using the Service at any time. You may request account deletion in product settings where available. We may suspend or terminate access for material breach or legal reasons, with notice where practicable.
